Terms of Service
These terms govern your use of EO-Atlas. By using the site, claiming a listing, or buying a paid plan, you agree to them.
1. About these terms
EO-Atlas is operated by SpectraWorks B.V. ("we", "us"), a private limited company registered in the Netherlands. Our full details are on the Legal identification page. These terms form an agreement between you and us. If you use EO-Atlas on behalf of a company or other organisation, you confirm that you are authorised to accept these terms for it, and "you" means that organisation.
2. Who can use EO-Atlas
Reading the catalogue is open to everyone. Accounts and paid plans are for business use: you must be at least 18 years old and acting for a business, organisation, or as a self-employed professional. Paid plans are sold on a business-to-business basis, and at checkout we ask for a valid VAT number.
3. The service
EO-Atlas is an openly editorial catalogue of Earth-observation sensors, missions, data products, companies, standards, and related subjects, compiled from public sources. The catalogue is free to read and a copy of the dataset is free to download. A paid plan adds enhancement features to a company listing you have claimed, such as images, links, and a richer company page. We may add, change, or remove features over time, and we will not make a change that materially reduces a paid feature you are using without letting you know.
4. Your account
You sign in with a one-time code sent to your email address. Keep access to that email secure. You are responsible for activity carried out through your account. Tell us promptly at info@spectraworks.nl if you think your account has been used without your permission.
5. Claiming and managing a listing
Claiming a listing lets you keep its information current and add the enhancement features described above. When you claim a listing you confirm that you are authorised to represent the organisation it describes, that the information you provide is accurate, and that you are not impersonating anyone. We may ask you to agree to additional claim terms, and we may verify a claim or reverse it if it appears to be wrong. The way we handle a disputed claim is also our mechanism for reports under the Digital Services Act (see section 10).
6. Acceptable use
You agree not to:
- break the law, or use EO-Atlas to facilitate anything unlawful;
- claim a listing you are not authorised to manage, or impersonate any person or organisation;
- upload content that is illegal, infringing, misleading, or that you do not have the rights to use;
- interfere with the service, probe or breach its security, or place an unreasonable load on it;
- collect personal data from the site for unlawful purposes, or use contact details published here to send unlawful or unsolicited messages.
Reading and reuse of the open dataset under its licence (section 8) is welcome and is not restricted by this section.
7. Content you provide
You keep ownership of the images, text, links, and other content you add to a listing. You grant us a worldwide, non-exclusive, royalty-free licence to host, display, and distribute that content as part of running and promoting EO-Atlas, for as long as it is on the site. You confirm that you have the rights to grant that licence and that your content does not break the law or infringe anyone else's rights. We may remove content that breaches these terms or that we are required to remove.
8. Our catalogue and database rights
We compile the EO-Atlas catalogue from public sources. To the extent it is protected by the European Union sui generis database right or by copyright, those rights belong to SpectraWorks B.V. We license the dataset to everyone under the Creative Commons Attribution 4.0 International licence (CC BY 4.0): you may share and adapt it, including for commercial use, as long as you give appropriate credit to EO-Atlas. Enhancement content that operators add to their own listings is not part of that licence and stays with its owner.
9. Accuracy and no advice
EO-Atlas is a reference. We compile entries from public sources and we state facts so that you can judge them; we do not rank entries or tell you what is "best". We keep the catalogue accurate as far as we can, but we provide it "as is" and do not warrant that every entry is complete, current, or free of error. Nothing on EO-Atlas is professional, legal, or investment advice. Check the original sources before you rely on anything here for an important decision. If you believe one of our own entries is wrong, tell us at info@spectraworks.nl and we will look into it.
10. Reporting illegal content
EO-Atlas lets verified operators edit their own listings, which makes it an online platform under the EU Digital Services Act. If you believe content on EO-Atlas is illegal, you can report it as set out on our Digital Services Act page. We review reports, act where required, and explain our decision to the people involved. We moderate content by human review, not by automated decision-making, and when we restrict or remove content we give the affected operator a statement of reasons and a way to dispute it.
11. Fees, billing, and tax
The price and billing period of each paid plan are shown before you buy. Paid plans renew automatically for further periods until you cancel. Payments are handled by our payment provider, Stripe. Because plans are sold business-to-business, VAT is handled under the EU reverse-charge rules where they apply, based on the VAT number you give us. We may change prices for future billing periods, and we will tell you before a change takes effect.
12. Refunds and cancellation
Paid plans come with a money-back guarantee, and you can cancel at any time. The details are on our Refund and Cancellation page, which forms part of these terms.
13. Suspension and termination
You can stop using EO-Atlas at any time and cancel any paid plan as described above. We may suspend or end your access if you seriously or repeatedly break these terms, or if we are required to by law. If your account ends, for whatever reason, your paid enhancement features stop and the listing returns to a standard catalogue entry compiled from public sources. We handle any personal data as described in our Privacy Policy.
14. Warranties and disclaimers
We provide EO-Atlas with reasonable skill and care, but we do not guarantee that the service will be uninterrupted or error-free, or that it will always be available. Except as these terms expressly say, and as far as the law allows, we exclude all other warranties, whether express or implied.
15. Liability
Nothing in these terms limits or excludes our liability where it would be unlawful to do so. This includes liability for intent or deliberate recklessness (opzet of bewuste roekeloosheid), for death or personal injury caused by our negligence, and for anything else that Dutch mandatory law does not allow us to exclude.
Subject to that, our total liability to you arising out of or in connection with EO-Atlas is limited to the fees you paid us in the twelve months before the event that gave rise to the claim. We are not liable for indirect or consequential loss, loss of profit or revenue, or loss of or damage to data. Because much of EO-Atlas is free, where you have paid us nothing our liability to you is limited to putting right the problem or, if we cannot, to a reasonable remedy permitted by law.
16. Your responsibility to us
If someone brings a claim against us because of content you provided or because you broke these terms or the law, you agree to cover the reasonable losses, costs, and damages we incur as a result, to the extent the claim is caused by what you did.
17. Changes to these terms
We may update these terms as EO-Atlas develops or as the law changes. The current version, with its date, is always on this page. If we make a significant change that affects a paid plan, we will tell you. If you keep using EO-Atlas after a change takes effect, you accept the updated terms.
18. Governing law and disputes
These terms, and any dispute arising out of them or out of your use of EO-Atlas, are governed by Dutch law. Disputes will be dealt with by the competent court in the Netherlands for the place where we are established, unless mandatory law gives you the right to bring the matter before another court.
19. General
If any part of these terms is found to be invalid, the rest stays in force. If we do not enforce a term straight away, we can still enforce it later. You may not transfer your rights or obligations under these terms without our agreement; we may transfer ours as part of a reorganisation or sale of the business, without reducing your rights. These terms, together with the Privacy Policy, Cookie Policy, and Refund and Cancellation page they refer to, are the whole agreement between you and us about EO-Atlas. These terms are written in English, which is the governing language.
